Protecting your family and property was created by FIllet
Afternoon

Just wanted to check perhaps someone had similar scenario, night before last they tried to break in through lounge window at 2AM to which I grabbed my gun locked my family inside and went hunting for them - this was in the front yard and I think they saw my canon, with no sign of them I went back in. Being unable to sleep I went to make coffee with wife in the kitchen, still having my gun out I see them jump back over the Hollywood type garage 30 min later. The one was right by the window so I pulled my magnum and shot ( a warning round) but first stuck it in his face. Round went through the granny flat door and into the wall. Ran outside again looking for them, one must have got away and I found one up in a tree, grabbed his foot pulled him down and out of sheer anger smashed his head with my gun, three times, kicked him about seven - got him up and punched him around four times. Unfortunately security company rocked up as I was beating him and detained him. Cops then rocked up asking how he was so fucked up. Told them I got a fright and hit him once. Never told them about warning round. Luckily he cut himself on the fence and was bleeding from that although security company did see me and neighbours tried to stop me thinking I was gonnna kill him. Neighbours already said they will deny the beating.

Are you still allowed to fire a warning round?
How much trouble can I get into for beating him like that if he was in my property?

Thanks, I just want to see if anyone else has had this and what happened? Take your gun, get in shit for the beating?

I laid charges and cops took him away but treated me like the criminal, investigator has been out for blood swabs etc. etc. Still waiting for detective who will follow the case through.

Oh yes, both occasions security and cops were called out so there is record of that.

if you called the first time they were on your property you can argue that you were afraid and reacted out of fear.

i don't think warning shots are a thing anymore (someone can correct me). if your life is in danger you shoot to save yourself buddy... self defence, because murderers don't give warning shots.

i had a similar experience except i got hold of the guy first time around. kicked the shit out of him but luckily the cops know me as part of the neighborhood watch and we came to realise that he fell and hurt himself like that hahaha
sad part is that he cannot go to prison as he did not steal anything and did not harm anyone. trespassing cases get thrown out and he is back on the streets the next day... where we got hold of him on another property in the area. this time didn't call the cops and sorted him out good and proper. never saw him in the area again!

You are right he will be out in no time.
Perhaps if I drop the charges the firing of my weapon wont come out of his mouth.
I know he won't be back.

well you did fire a warning shot. you can mention it was a warning and he didn't leave the property.
it's especially bad since they came back a second time... and you have proof of this because you reported it both times. him being on your property a second time definitely counts against him.

after being shot at and kicked in his moer... doubt he would ever think of coming back lol

Hi Fillet.

When the Act was revised firing warning shots are prohibited. These have been cases where guys shot their better half or a child who came close without the knowledge of the person handling the fire arm out of curiosity and some were killed. There definitely is a chance of you loosing the fire arm if you are declared incompetent or you fail to demonstrated adequate knowledge of the Act. Also under what section is your fire arm licenced and motivated? Section 13 is self protection. Occaisional sport shooting is section 15 make sure and get back to me.

Enlist the help of a Attorney a good one rather safe than sorry. Don't say to much most compromise themselves like that.

Do you have any signs up saying do not tress pass?

The law protects them. They just turn around saying they wanted ask you for food or a job. Yeah even at 2/3 AM

It is on you. It always has been...

I took out my firearm for self defence those years and you had too go for training - competency... In the training manual it was mentioned that if you need to fire a warning round then always into a corner which I did. Didn't know of a revised act hence my post.

Wife spoke to an attorney today, just spoke with her now, he said if detective asks tell him you prefer to remain silent and he defends it for you.

No signs like that just Chubb signs. Can he claim he was trying to ask for a job if he had already broken the window? That he came back a 2nd time?

Thanks bud. Sorry if any typos, auto correct from my cell.

Sorry to hear bud, RooiBul is on the spot when it comes to the Act and what it allows, well done on the beat down at least you didnt kill him.

We usually tie them to a post so they cant move, gag them and then we wet them and give some electricity while we wait for the cops...

Just had a long chat with my brother in law who does gun training.. Just came back from the state's doing further courses now, he is going to quickly see if his lawyer friend can take a phone call quick and I'll give admin his number so you can call him.. He said two options you keep quite if you have the shell but if they ask neighbours things you could be in shit.. He said he would declare it to prevent any problems but he would take legal advice if it was him. Stand by.

Cyclo has seen the pics of where I shot and only one round was used. Was just a warning. Balance was physical.

I would've fixed the wall and replaced the door.

It is all about proving what you alleged in their case when it comes to that on their side.

I'll get back to you shortly

@ Fillet - I know you wanted to chat to people that share the same interest as you, we on this forum most probably understand you better than most, but unfortunately south africa is full of fucked up people that nails the good people. Well, its actually a fucked up world as the bad people get away with everything, and the good people kak

You cannot post/type/tex/whatsapp/skype or touch a thing that can become proof if you feel you could have made the wrong choice. You dont talk to fucking no one but a legal guy first, then you do what he tells u.

You are hotheaded like any man that protects his shit, but protecting your shit in 2017, will get you into shit. Thats fucked up but its a fact.

It will become a criminal lawsuit and the racist shit will be dragged into it. If you need a criminal lawyer that i personally trust, i can assist.

Fillet.

The best after discussions would be to do like Mack said. Let a lawyer/attorney defend you and handle it.
